Intercourse during Menstruation

Allah says
:

"
They ask you concerning menstruation . Say : that is an adhaa ( a harmful thing for a husband to have s.e.x.ual intercourse with his wife while she is having her menses ) , therefore keep away from women during menses and go not unto them till have purified ( from menses and have taken a bath
" …. (
[ Surah al-Baqarah (2):222 ]

So a man is not permitted to approach his wife until her period has ended and she has taken a bath ( ghusl ) . Allah says
:

"
And when they purified themselves , then go in unto them as Allah has ordained for you
"

[ Surah al-Baqarah (2):222 ]
The repulsive nature of this sin is indicated by the words of the Prophet
:

"
Whoever has intercourse with a menstruating woman , with a woman in her rectum , or goes to a fortune-teller has disbelieved in what was revealed to Muhammad
."

Whoever does this by mistake , not deliberately , does not have to pay any penalty , but the person who does it deliberately and with full knowledge of what he is doing must do so , which , according to the scholars with the soundest knowledge , is one dinar or half a dinar . Some scholars say that there is a choice in the amount to be paid ; others say that if a man has intercourse with his wife at the beginning of her period , when the flow of blood is heavy , he must pay one dinar , and if he does it at the end of her period when the flow is light , he must pay half a dinar . In modern terms , a dinar is equal to 4.25 grams of gold : this or the e.q.u.i.v.alent amount of currency must be given in charity

The translation into Arabic
وطء الزوجة في حيضها

قال تعالى :
" و يسألونك عن المحيض قل هو أذى فاعتزلوا النّساء في المحيض و لا تقربوهنّ حتى يطهرن "
/ سورة البقرة ، الآية : 222 /
فلا يحلّ له أن يأتيها حتى تغتسل بعد طهرها لقوله تعالى :
" فإذا تطهّرن فأتوهنّ من حيث أمركم الله .. "
/ سورة البقرة ، الآية : 222 /
و يدل على شناعة هذه المعصية قوله صلى الله عليه و سلم :
" مِن أتى حائضاً أو امرأة في دبرها أو كاهناً فقد كفر بما أنزل على محمد "
/ رواه الترمذي عن أبي هريرة 1/243 و هو في صحيح الجامع 5918 /
و من فعل ذلك خطأ دون تعمد و هو لا يعلم فليس عليه شيء ، و من فعله عامداً عالماً فعليه الكفّارة في قول بعض أهل العلم ممن صحح حديث الكفّارة و هي : دينار أو نصف دينار .
و قال بعضهم : هو مخيّر فيهما .
و قال بعضهم : إذا أتاها في أول حيضها في فورة الدم فعليه دينار ، و إن أتاها في آخر حيضها إذا خفّ الدم أو قبل اغتسالها من الحيض فعليه نصف دينار ، و الدينار بالتقدير المتداول 25, 4 غراماً من الذهب يتصدق بها أو بقيمتها من الأوراق النقدية .
/ و الصواب أنه مخيّر بين الدينار و نصفه سواء كانت في أول الحيض أو في آخره ، و الدينار أربعة أسباع الجنيه السعودي و نصفه سبعان اثنان من السبعة لأن الجنيه السعودي ديناران إلا ربع (ز) /
